The terms “we”, “us” and “our” refer to Miniature Dolls House – Furniture & Accessories. We operate the website www.miniaturedollshouse.co.uk, including the online store and its related information, content, features, tools, products and services.
Our website and online store are hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and services to you.
These Terms & Conditions, together with our Privacy Policy, Refund Policy, Shipping Policy and any other policies referred to within them, explain the terms that apply when you visit our website, create an account, place an order or otherwise use our services.
Please read these Terms & Conditions carefully before using our website or placing an order. They contain important information about your legal rights, responsibilities and the basis on which we supply products to you.
By accessing our website, creating an account, placing an order or otherwise using our services, you agree to be bound by these Terms & Conditions and the policies referred to within them.
If you do not agree to these Terms & Conditions, you must not use our website or purchase products through it.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
1. About Us
This website is operated by Miniature Dolls House – Furniture & Accessories.
Our contact details are:
Business name: Miniature Dolls House – Furniture & Accessories
Website: www.miniaturedollshouse.co.uk
Email: hello@miniaturedollshouse.co.uk
Any additional business information required by law, including our trading address and company or VAT registration details where applicable, will be displayed on our website, order documentation or other relevant customer communications.
2. Accessing Our Website
You may access and use our website only for lawful purposes and in accordance with these Terms & Conditions.
You must be at least 18 years old and legally capable of entering into a binding contract to place an order through our website.
Customers under the age of 18 may browse the website but must not place an order unless the order is made or authorised by a parent, guardian or other responsible adult.
We may suspend, withdraw, restrict or change access to all or any part of our website where reasonably necessary, including for maintenance, security, operational or legal reasons.
We do not guarantee that our website, or any content on it, will always be available, uninterrupted or free from errors.
3. Customer Accounts
You may be able to create an account to manage orders, addresses and other information.
When creating an account or placing an order, you agree to provide information that is accurate, complete and current.
You are responsible for:
Keeping your account details and password secure.
Restricting access to devices through which your account may be accessed.
Informing us promptly if you believe your account has been accessed without permission.
Ensuring that your contact, billing and delivery information remains accurate.
You are responsible for activity undertaken through your account unless the activity results from something for which we are legally responsible.
You must not sell, transfer, assign, license or otherwise provide your account to another person.
We may suspend or close an account where we reasonably believe it has been misused, compromised or operated in breach of these Terms & Conditions.
4. Our Products
We take reasonable care to ensure that product descriptions, measurements, photographs and other information displayed on our website are accurate.
However, many of our products are handmade, assembled, finished or manufactured using 3D-printing processes. Minor differences between individual products may therefore occur.
These differences may include slight variations in:
Colour or shade.
Texture or surface finish.
Dimensions.
Layer lines or printing patterns.
Positioning or assembly.
Decorative details.
Such minor variations are part of the manufacturing or handmade nature of the products and will not necessarily mean that a product is faulty.
Product photographs and rendered images are intended to provide a representative illustration. Colours and appearance may vary depending on your screen, device settings, lighting and display configuration.
Unless expressly stated otherwise, accessories, dolls, furniture, plants, room settings and decorative objects shown in lifestyle photographs are not included with the product.
Measurements are approximate unless expressly described as exact. Customers should check the stated dimensions before ordering, particularly where a product is intended to fit within a specific dolls house, room, window, doorway or display.
We reserve the right to amend product descriptions, specifications, prices or availability and to discontinue products without notice.
5. Miniature Products and Safety
Our products are miniature collectors’ items, decorative accessories or components intended for use in dolls houses and miniature displays.
Unless a product is expressly described as a toy suitable for children, our products are not toys and are not intended for unsupervised play.
Products may contain:
Small parts.
Detachable components.
Sharp points or edges.
Magnets.
Decorative finishes.
Materials that could present a choking hazard.
Products should be kept away from babies and young children. Adult supervision is required whenever a product is handled by a child.
Customers are responsible for reading and following any age guidance, safety information, warnings or instructions shown on the relevant product page or packaging.
Products must not be placed in the mouth, swallowed, used with food or drink, exposed to naked flames, used as electrical components or used for any purpose other than their intended decorative or miniature-display purpose.
6. Placing an Order
When you submit an order through our website, you are offering to purchase the products in your basket in accordance with these Terms & Conditions.
After you place an order, you should receive an email acknowledging that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.
A contract between you and us is formed when we:
Send you an order confirmation indicating that your order has been accepted;
Begin preparing a made-to-order or personalised product; or
Dispatch your order,
whichever occurs first.
We reserve the right to refuse or cancel an order where reasonably necessary. This may include circumstances where:
A product is unavailable.
Payment cannot be authorised.
Pricing or product information contains an obvious error.
We cannot deliver to the supplied address.
We suspect fraud, misuse or unauthorised activity.
An order breaches purchasing restrictions.
We believe products are being purchased for unauthorised commercial reproduction or resale.
We are unable to fulfil the order for reasons beyond our reasonable control.
Where we cancel an order after payment has been taken, we will refund the relevant amount using the original payment method.
7. Reviewing and Changing Your Order
You are responsible for reviewing your basket, product selections, quantities, colours, dimensions, personalisation details and delivery address before submitting an order.
Please contact us promptly if you need to request a change or cancellation.
We will try to accommodate reasonable requests, but we cannot guarantee that an order can be changed or cancelled after it has been accepted, prepared, manufactured, personalised, packed or dispatched.
Your statutory cancellation rights, where applicable, are explained in our Refund Policy and Section 12 of these Terms & Conditions.
8. Personalised and Made-to-Order Products
Some products may be manufactured, customised or personalised according to information supplied by you.
You are responsible for checking that all names, wording, colours, measurements and other customisation details are correct before submitting your order.
We will manufacture personalised products using the information you provide. We are not responsible for errors contained in customer-supplied information unless we have failed to follow that information correctly.
Once production has started, personalised, bespoke or made-to-measure products may not be changed or cancelled.
Statutory cancellation rights may not apply to products made to your specifications or clearly personalised, although this does not affect your rights where an item is faulty, damaged, misdescribed or has not been made in accordance with the agreed specification.
9. Prices and Payment
Product prices will be displayed on our website.
The price payable will normally be the price shown at the time you submit your order, subject to the correction of obvious pricing errors.
Prices may change at any time, but changes will not normally affect orders that have already been accepted.
Unless stated otherwise, prices displayed on our website include any applicable UK VAT for which we are responsible.
Delivery charges and any other applicable costs will be displayed before you complete your order.
You agree to provide accurate and complete billing and payment information and confirm that you are authorised to use the payment method selected.
Payment must be authorised before an order can be accepted or dispatched.
Payments may be processed by Shopify Payments or another third-party payment provider. We do not directly store complete payment-card details where those details are processed securely by a third-party provider.
10. Pricing Errors
Despite our reasonable efforts, products may occasionally be incorrectly priced.
If the correct price is lower than the price stated when you ordered, we may charge the lower amount.
If the correct price is higher, we may contact you before accepting or dispatching the order to ask whether you wish to proceed at the correct price.
We are not required to supply a product at an obviously incorrect price where the pricing error could reasonably have been recognised as a mistake.
Where an affected order is cancelled, any payment already taken will be refunded.
11. Promotions and Discount Codes
Promotions, discount codes and special offers may be subject to separate terms.
Unless stated otherwise:
Promotions cannot be used retrospectively.
Discount codes cannot be exchanged for cash.
Only one discount code may be used per order.
Discounts may exclude particular products, collections or delivery charges.
Promotions may be withdrawn or amended before an order is placed.
Discount codes must not be reproduced, sold or distributed without permission.
Where promotional terms conflict with these Terms & Conditions, the specific promotional terms will apply to that promotion.
We may reject or cancel the use of a discount code where we reasonably believe it has been used fraudulently, unlawfully or contrary to its stated conditions.
12. Consumer Cancellation Rights
Customers purchasing online as consumers will normally have the right to cancel an eligible order within 14 days without giving a reason.
The cancellation period generally begins on the day after you, or a person nominated by you, receives the goods.
To exercise your cancellation right, you must inform us clearly that you wish to cancel within the applicable cancellation period.
After notifying us, you will normally have a further 14 days in which to return the products.
Cancellation rights may not apply to certain products, including:
Products made to your specifications.
Clearly personalised or bespoke products.
Sealed products that are not suitable for return for health-protection or hygiene reasons once unsealed.
Products that have become inseparably mixed with other items after delivery.
Other products excluded from cancellation rights by applicable law.
Further information about cancellations, returns, return postage and refunds is set out in our Refund Policy.
Nothing in this section affects your legal rights where goods are faulty, damaged, misdescribed or otherwise do not conform to the contract.
13. Returns and Refunds
Returns and refunds are handled in accordance with our Refund Policy, which forms part of these Terms & Conditions.
Where you are exercising a statutory cancellation right, products must be returned without undue delay and no later than 14 days after informing us of the cancellation.
You may handle a product only to the extent reasonably necessary to establish its nature, characteristics and functioning, in the same way that you might examine it in a physical shop.
Where handling goes beyond what is reasonably necessary and reduces the value of a product, we may make a lawful deduction from the refund.
Unless the goods are faulty, damaged, misdescribed or otherwise non-conforming, you may be responsible for the direct cost of returning cancelled products, as explained in our Refund Policy.
Refunds will be made using the original payment method unless otherwise agreed.
14. Faulty, Damaged or Incorrect Products
Products supplied to consumers must be:
Of satisfactory quality.
Fit for any particular purpose made known to us.
As described.
Supplied in accordance with the contract.
Please contact us as soon as reasonably possible if your order arrives damaged, contains an incorrect item or appears to be faulty.
We may ask you to provide photographs, order details or other reasonable information to help us assess the issue.
Depending on the circumstances and your statutory rights, an appropriate remedy may include:
Repair.
Replacement.
Price reduction.
Refund.
Nothing in these Terms & Conditions limits the rights and remedies available to consumers under applicable law.
15. Shipping and Delivery
Available delivery methods, estimated delivery periods and charges will be shown during checkout or in our Shipping Policy.
Delivery dates and times are estimates unless we have expressly agreed that a particular date is essential.
We will take reasonable steps to deliver orders without undue delay. Unless another period has been agreed, consumer orders should normally be delivered within 30 days after the contract is formed.
We are not responsible for delays caused by circumstances outside our reasonable control, but we will take reasonable steps to keep you informed and minimise the effect of the delay.
You are responsible for providing a complete and accurate delivery address.
Where an order cannot be delivered because the supplied address is incorrect or incomplete, or because no one is available to accept it, you may be responsible for reasonable redelivery or return costs.
16. Risk and Ownership
For purchases made by consumers, responsibility for the goods normally remains with us until they are delivered into the physical possession of:
You;
A person identified by you to receive the goods; or
A carrier independently arranged by you and not offered by us as a delivery option.
Ownership of the goods will pass to you when we have received payment in full and the goods have been delivered.
This section does not affect your statutory rights.
17. International Orders
Where international delivery is available, you are responsible for checking that the products may lawfully be imported into and used within the destination country.
International orders may be subject to:
Import VAT.
Customs duties.
Clearance charges.
Local taxes.
Brokerage or handling fees.
Unless expressly stated otherwise during checkout, these charges are not included in the purchase price or delivery charge and are the customer’s responsibility.
Customs procedures may cause delays outside our control.
International customers may have rights under mandatory laws applying in their country of residence. Nothing in these Terms & Conditions excludes rights that cannot lawfully be excluded.
18. Intellectual Property
All intellectual property rights in our website, products, designs and content belong to us or are used by us under licence.
This includes, without limitation:
Product designs.
Three-dimensional designs and models.
Product names.
Photographs and rendered images.

Without our prior written permission, you must not:

Create moulds, casts, patterns or tooling from it.
Produce a substantially similar or derivative commercial product.
Commission another person or business to reproduce it.
Sell, distribute or manufacture copies or replicas.
Use a product as a master, template or reference for commercial reproduction.
These restrictions do not limit any act that cannot lawfully be restricted, but they apply to the fullest extent permitted by law.
20. Digital Reproduction and 3D Printing
You must not use our products or website content to create an unauthorised digital or manufacturing copy.
This includes using any product to:
Create a 3D scan.
Generate a photogrammetry model.
Produce a CAD drawing or digital reconstruction.
Create an STL, 3MF, OBJ, STEP or other manufacturing file.
Train an artificial-intelligence system to recreate the design.
Manufacture a copy by 3D printing, CNC machining, moulding, casting, injection moulding or another process.
You must not publish, sell, license, distribute, share or otherwise make available any unauthorised digital representation or reproduction of our products.
Unauthorised reproduction may breach these Terms & Conditions and infringe our intellectual property rights.
21. Reviews, Feedback and Customer Content
You may be able to submit reviews, photographs, comments, suggestions or other content.
You confirm that content you submit:
Is accurate and reflects your genuine experience where presented as a review.
Is owned by you or submitted with the necessary permission.
Does not infringe another person’s rights.
Is not defamatory, discriminatory, threatening, obscene or unlawful.
Does not contain malicious software, spam or misleading advertising.
Does not disclose another person’s private information without permission.
Does not misrepresent your identity or relationship with us.
You retain ownership of your content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, edit, publish, display and use it for operating, improving and promoting our business, products and services.
This licence continues for as long as reasonably necessary for those purposes, subject to applicable data-protection and consumer laws.
Where a review or endorsement was submitted in return for payment, a free product, a discount or another incentive, this must be clearly disclosed.
We may moderate, reject or remove content that we reasonably believe breaches these Terms & Conditions or applicable law.
22. Errors, Inaccuracies and Availability
Our website may occasionally contain typographical errors, inaccurate information or omissions relating to:
Product descriptions.
Measurements.
Prices.
Promotions.
Stock availability.
Delivery charges.
Delivery estimates.
Product images.
We may correct errors and update information at any time.
Where an error materially affects an order that has already been submitted, we will contact you where reasonably possible and provide an appropriate option, which may include confirming the corrected information or cancelling the affected item for a refund.
Product availability is not guaranteed until an order has been accepted.
23. Third-Party Tools and Services
Our website may provide access to tools, applications, payment services or other functionality supplied by third parties.
These services may be subject to separate terms and privacy policies imposed by their providers.
We do not control third-party services and are not responsible for their availability, security or performance except where responsibility cannot legally be excluded.
You should review the relevant provider’s terms before using a third-party service.
We may introduce new tools, features and services in the future. Unless otherwise stated, those additions will form part of our services and will be subject to these Terms & Conditions.
24. Third-Party Links
Our website may contain links to websites or services operated by third parties.
Links are provided for convenience and information only. Their inclusion does not necessarily mean that we approve, endorse or control the linked website or its content.
We are not responsible for third-party websites, products, services, policies or practices.
You access third-party websites at your own discretion and should review their terms, privacy policies and other applicable information before entering into a transaction.
Questions or complaints about a third-party product or service should be directed to the relevant provider.
25. Relationship with Shopify
Miniature Dolls House – Furniture & Accessories is powered by Shopify, which enables us to provide our online store and related services.
However, purchases made through our store are made directly between you and Miniature Dolls House – Furniture & Accessories.
Shopify is not the seller of our products and is not responsible for fulfilling orders, handling product enquiries or providing remedies relating to products purchased from us.
To the extent permitted by applicable law, Shopify and its affiliates are not responsible for injury, damage or loss arising from products purchased directly from us.
Nothing in this section excludes any responsibility that Shopify may have directly to you under applicable law or under a separate service it provides to you.

What personal information we collect.
Why we collect it.

We may suspend or restrict access where we reasonably believe these conditions have been breached.
28. Automated Agents
For the purposes of this section, an “Agent” means software that acts autonomously or semi-autonomously on behalf of a person or organisation, including purchasing agents, browsing agents and artificial-intelligence systems.
Agents must not access or interact with our website where we have expressly prohibited that access through technical measures, published instructions or direct notice.
Any permitted Agent must:
Identify itself accurately.
Avoid impersonating a human user.
Comply with applicable technical restrictions.

These Terms & Conditions have been materially breached.
Fraudulent or unlawful activity is suspected.

31. Disclaimer
We take reasonable care to ensure that general information displayed on our website is accurate. However, it is provided for general information and shopping purposes and should not be treated as professional, technical or safety advice.
We do not guarantee that:
The website will always be available or uninterrupted.
The website will be entirely free from errors or harmful components.
General website content will be suitable for every user or purpose.
Products will look identical under every lighting condition or on every display.
Products are supplied subject to the descriptions and terms applicable at the time of purchase.

Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Breach of statutory rights that cannot lawfully be excluded.
Defective products where liability cannot legally be excluded.
Any other liability that it would be unlawful to exclude or limit.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable consequence of our breach of these Terms & Conditions or our failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable when the contract was formed.
Products supplied through our standard retail website are intended for domestic, personal and collectors’ use. Unless expressly agreed in writing, we are not responsible for business losses, including loss of profit, revenue, business opportunity, anticipated savings, goodwill or business interruption.
We are not responsible for damage caused by:

33. Business Customers
If you purchase products wholly or mainly for business purposes, you confirm that you are acting as a business customer rather than a consumer.
For business purchases:
Any contract is between us and the business named in the order.
You confirm that you have authority to bind that business.
Consumer cancellation rights may not apply.
Our liability for indirect or consequential business losses is excluded to the fullest extent permitted by law.
Our total liability relating to an order will not exceed the amount paid for the affected products, except where liability cannot legally be limited.
Products must not be resold unless purchased through an approved trade or reseller arrangement or otherwise authorised by us.
Approved trade customers are also subject to our separate Trade & Reseller Terms & Conditions. Where those terms conflict with these general terms in relation to a trade purchase, the Trade & Reseller Terms & Conditions will take priority.
34. Your Responsibility for Breaches
You are responsible for losses that we reasonably incur as a direct result of your fraudulent, unlawful or deliberate misuse of our website or your material breach of these Terms & Conditions.
This does not require a consumer to compensate us for losses that are disproportionate, unforeseeable or caused by something for which we are responsible.
Nothing in this section limits any rights or remedies available to either party under applicable law.
35. Severability
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary to make it enforceable.
If modification is not possible, the affected provision will be treated as deleted.
The remaining provisions will continue in full force and effect.
36. Waiver
If we delay or fail to enforce a right under these Terms & Conditions, that does not mean that we have waived that right.
A waiver relating to one breach will not automatically constitute a waiver of a later breach.
37. Entire Agreement
These Terms & Conditions and the policies referred to within them constitute the agreement between you and us regarding your use of the website and purchase of products.
They supersede previous discussions, communications or versions relating to the same subject matter.
Nothing in this section excludes liability for fraud or fraudulent misrepresentation.
38. Assignment
You may not transfer your rights or obligations under these Terms & Conditions to another person without our prior written consent.
We may transfer our rights and obligations to another organisation, provided that doing so does not reduce the rights or protections available to you.
Where required, we will notify you of such a transfer.
39. Third-Party Rights
Except for any rights expressly granted to Shopify under the section concerning our relationship with Shopify, a person who is not a party to a contract between you and us will not normally have a right to enforce its terms.
The rights of the parties to cancel, vary or settle a contract are not subject to the consent of another person unless applicable law requires otherwise.
40. Governing Law and Jurisdiction
These Terms & Conditions and any contract between you and us are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom, you may also benefit from mandatory protections provided by the laws of that jurisdiction and may bring proceedings in the courts available to you under applicable law.
If you are a business customer, the courts of England and Wales will have exclusive jurisdiction over disputes arising from or connected with these Terms & Conditions or any order.
41. Alternative Dispute Resolution
Please contact us first if you have a complaint so that we have an opportunity to resolve it.
We will consider complaints fairly and aim to respond within a reasonable period.
Where we are legally required to provide information about an approved alternative dispute resolution provider, we will provide those details to you.
Nothing in this section restricts your right to seek independent advice or bring a claim before a court.
42. Changes to These Terms
The latest version of these Terms & Conditions will be available on this page.
We may update them from time to time to reflect changes to:
Our products or services.
Our business practices.
Technology or security requirements.
Shopify features.
Applicable laws or regulations.
Changes will not normally apply retrospectively to orders already accepted unless the change is required by law or is expressly agreed with you.
Your continued use of the website after updated terms are published means that the updated terms will apply to your subsequent use of the website and future orders.
43. Headings
Section titles and headings are included for convenience only.
They do not affect the meaning or interpretation of these Terms & Conditions.
